The Santa Fe County Community Development Department: Tourism & Marketing Division is encouraging residents and visitors alike to find their "Santa Fe County Adventure" this Spring.

Visit places around Santa Fe County and post the photo with your location on Instagram with the hashtag #santafecountycontest and tag our Instagram handle @santafecountynmtrue and be entered to win gift cards and attraction passes! With weekly giveaways, as well as a final grand prize package, you’ll have multiple opportunities to win.
Contest is open between May 20 through June 28, 2024. Photos submitted after the closing date will not be entered.
Posted photos must be set to public to ensure entries can be seen. Winners will be chosen at random, with several small prizes from individual businesses and a grand prize package. You must use both our hashtag #santafecountycontest and our handle @santafecountynmtrue to be entered to win.
Submitted photos to Santa Fe County may be showcased on participating Santa Fe County/Santa Fe County Tourism social media channels and Santa Fe County Tourism promotional materials. By uploading an entry to participate in the Contest, you the Entrant have affirmatively reviewed, accepted and agreed to all the Official Rules.

Definitions
In these Official Contest Rules (“Rules”), the following terms have the meanings set out below. In addition, other capitalized terms have the meaning so given to them.
“Administrator” means Sunny 505, in conjunction with Votigo for random automated drawings.
“Contest” means the contest, game, sweepstakes, promotion, marketing activity or other event specified.
“Contest Facilitators” means, collectively, the Administrator, the Organizer and any sponsors arranged by the Organizer.
“Contest Site” means https://santafenmtrue.com and Instagram;
“Organizer” means Sunny 505.
“Prize” or “Prizes” means the prize or prizes (if there are multiple prizes) to be awarded for a particular Contest as specified in the Contest Summary.
“Region” means the United States of America.
“Site” means https://santafenmtrue.com and any services available thereon.
“Sponsor” means the organization, business or individual that is providing the prize or prize package: Santa Fe County.
The “Contest Requirements” are:
The person entering the Contest must be 21 years of age.
1. Eligibility: The Contest is FREE to enter and open to all individuals, who are legal residents of the Region(s) specified, who sign up at https://santafenmtrue.com, and have reached the age of 21 at the time of their Entry (as defined below). It is your responsibility to ensure that you are legally eligible to enter the Contest under any laws applicable to you in your jurisdiction of residence or otherwise. This Contest is subject to federal, state, and provincial or local laws and regulations and void outside the Region specified and where prohibited by law. The employees, officers and directors of the Contest Facilitators (Santa Fe County Community Development Department employees; Santa Fe County Attorney’s Office; Sunny 505 employees; and Votigo employees) as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, officer and director are not eligible to participate in the Contest.
2. Sponsorship. The sponsor is Santa Fe County (“Sponsor”), located at 100 Catron Street, Santa Fe New Mexico 87501-2061. The sponsor will conduct the Contest substantially as described in these Official Rules.
3. Agreement to Official Rules: By participating in the Contest, you fully and unconditionally agree to and accept these Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Contest. Whether or not you receive a Prize is contingent upon fulfilling all requirements set forth in these Rules. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering this Contest, you represent and warrant that you are eligible to participate based on eligibility requirements explained in the Official Rules. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content of this Santa Fe County Photo Contest. The Contest is subject to all applicable federal, state, and local laws, and is void where prohibited by law.
4. Contest Period: The contest will run only during the time period specified in the Contest Summary on the contest entry page.
5. How to Enter: To enter the Contest, upload a photo to Instagram with the #santafecountycontest. Only one entry (upload/post) with the contest hashtag per day is eligible. Your entry (“Entry”) must fulfill the contest requirements (“Contest Requirements”), to be eligible to win a Prize. Entries that do not include all the required information and adhere to the Rules will be considered void. Incomplete entries or those that do not adhere to the Official Rules or specifications will be disqualified at the Sponsor's sole discretion. The Contest Facilitators are not responsible for lost, misdirected or incomplete Entries. The Organizer determines if an Entry meets the Contest Requirements and otherwise complies with the Rules.
6. Rights Granted by you: By entering this Contest, you agree that:
(a) the Administrator, the Organizer, the Sponsor - Santa Fe County, any individual acting on the Sponsor and Organizer’s behalf, all collaborators, and the licensees successors, and assigns of the Sponsor and Organizer, shall, where permitted by law, for future advertising, trade, promotion and publicity, have the right to print, publish, broadcast, distribute and use in any manner and in any medium, now known or hereafter devised throughout the world in perpetuity, your submission, photo, portrait, voice, likeness, image, statements about the Santa Fe County Photo Contest, for news, publicity, advertising, promotional purposes, trade, information, and public relations. This use shall be without any further notice to you and without consideration, compensation, remuneration, review, consent, or approval from you, without limitation and compensation, and include the right to use your Instagram Account Name or Your Handle (and state/province/territory Example: "@santafenmtrue of Any State, Contest Winners").
(b) All entries submitted shall be original work of the participant submitting the submission and not violate anyone’s proprietary or intellectual property rights. Any entry that infringes upon intellectual property rights of others shall be void, and you, the participant that submits the void entry, shall defend or settle against such claims at your sole expense, and you shall indemnify, defend, and hold harmless the Sponsor and Organizer from any suit, action or claim.
(c) You have read, understood, accept and agree to be bound by the Administrator’s Terms of Service set out here and in the disclaimer at www.santafenmtrue.com.
7. Prizes: The Winner(s) of the Santa Fe County Photo Contest (the “Winner”) will receive the prizes listed below. The actual/appraised prize value may differ at the time the prize is awarded. The prize(s) shall be determined solely by the Sponsor. There shall be no cash or other prize substitution permitted except at the Sponsor’s discretion. The prize is non-transferable. The Winner, upon acceptance of the prize, is solely responsible for all expenses related to the prize, including without limitation any and all local, state, and federal taxes. The Winner shall not transfer assignment of the prize to others nor shall the Winner request the cash equivalent or prize substitution. By accepting the prize, the selected Winner grants permission for the Sponsor to use the Winner’s likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law. The Organizer will provide the Prize(s) to be awarded for a particular Contest. No substitution of a Prize will be made unless the Organizer, in its sole discretion, determines otherwise. A Prize must be accepted as awarded, and the odds of winning are dependent upon the total number of eligible Entries received for the Contest Period. If, as a result of an error relating to the entry process, drawing or any other aspect of the Contest, and there are more potential winners of Prizes than contemplated in these rules, there will be a random draw amongst all eligible Prize claimants after the Contest Closing Date to award the correct number of Prizes. Prizes include:

8. Odds: The total number of eligible entries received determines the odds of winning.
9. Winner(s): The Winner will be selected by a random drawing. The winner(s) (“Winner(s)”) of the Prize(s) will be selected, as specified in these Contest Rules, from all eligible Entries received. If you are selected as a Winner, you will be notified of the selection of your Entry by the phone or email address provided by you on the Registration Form. If the winner does not respond to the phone or email notification of your selection as a Winner within five (5) days, an alternate Winner will be selected to receive the Prize. The Sponsor is not responsible for nor shall have no liability for Winner’s failure to receive notices due to email security settings that may cause notifications to be marked as spam or junk email. Nor shall be Sponsor be liable for the Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner 1) fails to claim the prize within 10 days from the time the award notification was sent, 2) is found ineligible, or 3) does not complete and return an executed declaration and release within the specified timeframe, the prize may be forfeited and an alternate Winner may be selected. IF THE WINNER VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED. This format will include weekly winner(s), if applicable, and the final grand-prize winner. All decisions of the Organizer in selecting the winner(s) are final and binding on all Entrants in all matters relating to the Contest.
10. To Redeem Prize: Except where prohibited, Winner shall be required to execute and return to the Organizer within ten (10) days of the date notice or attempted notice is sent, an Affidavit of Eligibility and Release (“Affidavit of Eligibility and Release”) in order to claim the Prize. A Prize is personal to the Winner and is non-transferable. If a Winner cannot be contacted, or fails to execute and return the Affidavit within the required time period (if applicable), or if the Prize is returned as undeliverable, the Winner forfeits the Prize. Receipt of the prize offered in the Santa Fe County Photo Contest by the Winner is upon the condition of compliance with any and all federal, state, and local laws and regulations. Acceptance of any Prize shall constitute and signify the Winner's agreement and consent that the Contest Facilitators may use the Winner's name, photo, city, state, likeness, Entry and Prize information in connection with the Contest, worldwide, including on the internet, without limitation and without further payment or consideration, except where prohibited by law. Each Winner is responsible for all taxes and fees associated with receipt of the Prize.
11. Terms & Conditions: In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate the Santa Fe County Photo Contest should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor’s control, impact or corrupt the security, fairness, proper conduct, or administration of the Santa Fe County Photo Contest. The Contest Facilitators have the right to verify your eligibility and compliance with these Rules, and to disqualify you on the basis of its investigation.
The Sponsor, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Individuals who tamper with or attempt to tamper with the operation or entry process of the Santa Fe County Photo Contest or website or violates these Terms & Conditions will be disqualified by the Sponsor in its sole discretion. In its sole discretion, the Sponsor has the right to maintain the integrity of the Santa Fe County Photo Contest, to void entries for any reason, including, but not limited to: identify any disallowed entry methods that will result in votes/entries being voided; examples: multiple entries from the same user within the same day; multiple entries from the same computer beyond the number allowed by the Contest rules; or the use of bots, macros, scripts, or other technical means for entering.
Caution: Attempts by any entrant to deliberately damage any website or undermine the legitimate operation of the Santa Fe County Photo Contest may be a violation of criminal and civil laws. If any such attempt is made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.
You may not enter with multiple e-mail and/or street addresses, nor may you use any other device or artifice to submit more than one (1) entry per day. If you use fraudulent Entry methods, or otherwise attempt to participate with multiple e-mail and/or street addresses under multiple identities, or use any device or artifice to enter more than one (1) entry per day, you will be disqualified. In the event of a dispute as to any Entry, the authorized account holder of the e-mail address used to enter will be deemed to be the person who made the Entry. For the purposes of these Rules, the authorized “account holder” is the natural person assigned an e-mail address by an internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.
Nothing contained in these Rules shall be construed to: (i) give any party the power to direct and control the day-to-day activities of the other; (ii) constitute the parties as partners, joint ventures, principal and agent, employer and employee, co-owners or entrants in a joint undertaking; or (iii) allow you to create or assume any obligation on behalf of the Organizer. Contest Facilitators reserve the right to cancel, modify or suspend the Contest at any time (subject to approval of any regulatory body having jurisdiction), if it is determined that the Contest cannot be run as originally planned or if fraud or any other occurrence compromises the fairness or integrity of the Contest.
12. Liability Provisions: The Contest Facilitators are not responsible for human error, theft, destruction, or damage to Entries or other factors beyond its reasonable control. You assume all risk of damaged, lost, late, incomplete, invalid, incorrect or misdirected Entries. The Contest Facilitators make no warranty, representation or guarantee, express or implied, in connection with its ability to in any way enable, develop or market the idea set forth in your Entry.
The Contest Facilitators shall not be liable to a Winner or any other person for failure to supply the Prize or any part thereof, by reason of the Prize becoming for reasons beyond the reasonable control of the Contest Facilitators unavailable or impracticable to award, or for any force majeure event, technical or equipment failure, terrorist acts, labor dispute, or act/omission of any kind (whether legal or illegal), transportation interruption, civil disturbance, or any other cause similar or dissimilar beyond the Organizer’s control.
The Organizer, Administrator and their employees, officers, directors, agents, contractors, representatives, affiliates, divisions, subsidiaries, resellers, dealers, distributors, advertising/promotion agencies (the “Released Parties”) shall not assume any responsibility whatsoever for any of the following: delayed, failed, partial or garbled computer transmissions; technical failures of any kind, including, but not limited to, lost, interrupted or unavailable network, server, internet, or other connections; the availability, accessibility, technical failure or miscommunications of computer, satellite, telephone or cable transmissions; the incorrect or inaccurate capture or failure to capture information whether caused by Site or Contest Site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest; errors of any kind whether human, mechanical, electronic, network or otherwise arising out of or relating to the Contest; theft, loss, destruction or damage to an Entry in whole or in part; and other factors beyond their reasonable control. The Released Parties are not responsible for injury or damage to your or to any other person or your technological devices’ computer related to or resulting from participating in the Contest or downloading materials from or use of the Site or any Contest Site.
13. Governing Law: The Contest is governed by and subject to the laws of New Mexico, without respect to conflict of law doctrines, and all disputes will be decided in accordance with the laws of New Mexico. Void where prohibited by law. The Entrant agrees, as a condition of participating in this promotion, that if any disputes cannot be resolved between the Entrant and the Sponsor, and if causes of action arise out of or are connected with this Contest, they shall be individually resolved exclusively before a court located in New Mexico, having jurisdiction, without resorting to any form of class action. Under no circumstances in any such dispute shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). The participant waives all rights to have damages multiplied or increased.
14. Privacy Policy: This Contest may request personal information from you including your: Name, Email Address, Phone Number, State or Zip Code, Age. This personal information we collect is used to contact you in the event that you are selected to win a prize from the Contest, in addition to sending you special offers and other marketing material. We do not sell or otherwise share the information you provide to us via this Contest. This information is only used internally to compile anonymous statistics about our user base and to create a contact list for sending special offers and marketing material.
15. Winners List: A Winner’s list will be available on the contest site, https://santafenmtrue.com.
16. The Contest hosted by Santa Fe County is in no way sponsored, endorsed, administered by, or associated with Instagram.
